In 2000, a simple, foundational thermodynamic paradox was proposed: a sealed blackbody cavity contains a diatomic gas and a radiometer whose apposing vane surfaces dissociate and recombine the gas to different degrees (A $_{2} \rightleftharpoons $ 2A). As a result of differing desorption rates for A and A $_{2}$ , there arise between the vane faces permanent pressure and temperature differences, either of which can be harnessed to perform work, in apparent conflict with the second law of thermodynamics. Here we (...) report on the first experimental realization of this paradox, involving the dissociation of low-pressure hydrogen gas on high-temperature refractory metals (tungsten and rhenium) under blackbody cavity conditions. The results, corroborated by other laboratory studies and supported by theory, confirm the paradoxical temperature difference and point to physics beyond the traditional understanding of the second law. The UK government has recently committed to adopting a new policy—dubbed ‘Martha’s Rule’—which has been characterised as providing patients the right to rapidly access a second clinical opinion in urgent or contested cases. Support for the rule emerged following the death of Martha Mills in 2021, after doctors failed to admit her to intensive care despite concerns raised by her parents. We argue that framing this issue in terms of patient rights is not productive, and should be avoided. Insofar as (...) the ultimate goal of Martha’s Rule is the provision of a clinical service that protects patient safety, an approach that focuses on the obligations of the health system—rather than the individual rights of patients—will better serve this goal. We outline an alternative approach that situates rapid clinical review as part of a suite of services aimed at enhancing and protecting patient care. This approach would make greater progress towards addressing the difficult systemic issues that Martha’s Rule does not, while also better engaging with the constraints of clinical practice. (shrink)

Background: Conducting video-research in birth settings raises challenges for ethics review boards to view birthing women and research-midwives as capable, autonomous decision-makers. Aim: This study aimed to gain an understanding of how the ethical approval process was experienced and to chronicle the perceived risks and benefits. Research design: The Birth Unit Design project was a 2012 Australian ethnographic study that used video recording to investigate the physical design features in the hospital birthing space that might influence both verbal and non-verbal (...) communication and the experiences of childbearing women, midwives and supporters. Participants and research context: Six women, 11 midwives and 11 childbirth supporters were filmed during the women’s labours in hospital birth units and interviewed 6 weeks later. Ethical considerations: The study was approved by an Australian Health Research Ethics Committee after a protracted process of negotiation. Findings: The ethics committee was influenced by a traditional view of research as based on scientific experiments resulting in a poor understanding of video-ethnographic research, a paradigmatic view of the politics and practicalities of modern childbirth processes, a desire to protect institutions from litigation, and what we perceived as a paternalistic approach towards protecting participants, one that was at odds with our aim to facilitate situations in which women could make flexible, autonomous decisions about how they might engage with the research process. Discussion: The perceived need for protection was overly burdensome and against the wishes of the participants themselves; ultimately, this limited the capacity of the study to improve care for women and babies. Conclusion: Recommendations are offered for those involved in ethical approval processes for qualitative research in childbirth settings. The complexity of issues within childbirth settings, as in most modern healthcare settings, should be analysed using a variety of research approaches, beyond efficacy-style randomised controlled trials, to expand and improve practice-based results. The syllabus presented here is designed for use in the training of researchers and research ethics committee members throughout the European Union and beyond. It is intended to be accessible to scientific and lay readers, including those with no previous experience of ethical theory and analysis. The syllabus will cover key issues in the ethics of research involving human participants, including the ethical issues associated with new technologies.

The essay shows how Heidegger's understanding of physis in Aristotle lays the foundation for his understanding of Ereignis. The essay draws on Heidegger's lecture courses, published and unpublished, particularly "On the Being and Conception of Physis." After introductory remarks on how Heidegger reads Aristotle "phenomenologically" in general, the essay focuses on how Heidegger reads physis as a mode of Being (ousia) by reading kinesis as a mode of Being, specifically as energeia ateles (incomplete Being). But energeia ateles is characterized by (...) Heidegger as Wiederholung (retrieve of possibility) and as Eignung (appropriation of dynamis for appearance). On the basis of that crucial reading of physis, the essay goes on to show how physis-as-dynamis is the foundation for Ereignis in Sein und Zeit through the radical transformation of Wiederholung in natural beings into resolve in Dasein. In 1885, during initial discussions of J. C. Maxwell's celebrated thermodynamic demon, Whiting (1) observed that the demon-like velocity selection of molecules can occur in a gravitationally bound gas. Recently, a gravitational Maxwell demon has been proposed which makes use of this observation [D. P. Sheehan, J. Glick, and J. D. Means, Found. Phys. 30, 1227 (2000)]. Here we report on numerical simulations that detail its microscopic phase space structure. Results verify the previously hypothesized mechanism of its paradoxical behavior. (...) Motivation has been the subject of much research in the sport psychology literature, whereas athlete mental health has received limited attention. Motivational complexities in elite sport are somewhat reflected in the mental health literature, where there is evidence for both protective and risk factors for athletes. Notably, few studies have linked motivation to mental health. Therefore, the key objective of this study was to test four mental health outcomes in the motivational sequence posited by the Hierarchical Model of Intrinsic and (...) Extrinsic Motivation: motivational climate  basic psychological needs  motivation  mental health outcomes. Elite team-sport athletes (140 females, 75 males) completed seven psychometric inventories of motivation-related and mental health variables. Overall, the athletes reported positive motivational patterns, with autonomous motivation and task climate being more prevalent than their less adaptive counterparts. Elevated depressive symptoms and poor sleep quality affected nearly half of the cohort. Structural equation modelling supported pathways between motivational climate, basic needs, motivation, and mood, depressive symptoms, sleep quality, and trait anxiety. Specifically, a task climate was positively associated with the three basic psychological needs, and an ego climate was positively associated with competence. Autonomy and relatedness had positive and negative associations with autonomous and controlled forms of motivation, respectively. Controlled motivation regulations were positively associated with the four mental health outcomes. Integrated regulation had a negative association with anxiety, and intrinsic regulation had a positive association with depressive symptoms. These findings highlight the complexities of and interrelations between motivation and mental health among athletes, and support the importance of considering mental health as an outcome of motivation. A laboratory-testable, solid-state Maxwell demon is proposed that utilizes the electric field energy of an open-gap p-n junction. Numerical results from a commercial semiconductor device simulator (Silvaco International–Atlas) verify primary results from a 1-D analytic model. Present day fabrication techniques appear adequate for laboratory tests of principle.

The most‐critical point of reproductive development in all sexually reproducing species is the transition from mitotic to meiotic cell cycle. Studies in unicellular fungi have indicated that the decision to enter meiosis must be made before the beginning of the premeiotic S phase. Recent data from the mouse1 suggest that this timing of meiosis initiation is a universal feature shared also by multicellular eukaryotes. BackgroundCurrent guidelines do not clearly outline when assent should be attained from paediatric research participants, nor do they detail the necessary elements of the assent process. This stems from the fact that the fundamental justification behind the concept of assent is misunderstood. In this paper, we critically assess three widespread ethical arguments used for assent: children’s rights, the best interests of the child, and respect for a child’s developing autonomy. We then outline a newly-developed two-fold justification for the assent process: (...) respect for the parent’s pedagogical role in teaching their child to become an autonomous being and respect for the child’s moral worth.DiscussionWe argue that the ethical grounding for the involvement of young children in medical decision-making does not stem from children’s rights, the principle of best interests, or respect for developing autonomy. An alternative strategy is to examine the original motivation to engage with the child. In paediatric settings there are two obligations on the researcher: an obligation to the parents who are responsible for determining when and under what circumstances the child develops his capacity for autonomy and reasoning, and an obligation to the child himself. There is an important distinction between respecting a decision and encouraging a decision. This paper illustrates that the process of assent is an important way in which respect for the child as an individual can be demonstrated, however, the value lies not in the child’s response but the fact that his views were solicited in the first place.SummaryThis paper demonstrates that the common justifications for the process of assent are incomplete. Assent should be understood as playing a pedagogical role for the child, helping to teach him how specific decisions are made and therefore helping him to become a better decision-maker. How the researcher engages with the child supports his obligation to the child’s parents, yet why the researcher engages with the child stems from the child’s moral worth. Treating a child as having moral worth need not mean doing what they say but it may mean listening, considering, engaging or involving them in the decision. (shrink)

A recent article from Archives of Disease in Childhood outlined problems with the act of gaining child assent for research participation. However the arguments used in the article are incomplete or misguided. Rather than being harmful, assent should be seen as an ethically-appropriate way in which we can engage with the child about his participation in research. While additional clarification of the concept of assent is needed, the child's family context can provide us with a valuable guide to the way (...) we involve him in the decision-making process. A new member of a growing class of unresolved second law paradoxes is examined.(1–7) In a sealed blackbody cavity, a spherical gravitator is suspended in a low density gas. Infalling gas suprathermally strikes the gravitator which is spherically asymmetric between its hemispheres with respect to surface trapping probability for the gas. In principle, this system can be made to perform steady-state work solely at the expense of heat from the heat bath, this in apparent violation of the second law of (...) thermodynamics. Detailed three-dimensional test particle simulations of this system support this prediction. Standard resolutions to the paradox are discussed and found to be untenable. Experiments corroborating a central physical process of the paradox are discussed briefly. The paradox is discussed in the context of the Maxwell demon. (shrink)

Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

In August 2011, a group of medical doctors, ethicists, academic and medical physicists were asked to debate and reach consensus on the potential need for randomised control trials to test charged particle radiation therapy for treating tumours. The outcome of the meeting was a paper recently published in the Journal of Medical Ethics entitled “Position statement on ethics, equipoise and research on charged particle therapy” by Sheehan et al. However 6 of the 30 meeting participants withdrew from authorship of (...) the ‘position statement’ because their views were not adequately represented. The ‘position statement’ did not state our reasons for withdrawing from the statement, which is a considerable omission. We had two principal objections: the case for the benefits to patients and society of randomized trials to test CPRT was not adequately represented, and the complexities and potential harms of CPRT were not clearly stated. In this response we explain and justify our objections. Patients, doctors and policymakers seeking to make independent judgments about whether equipoise exists for the relative benefits of CPRT should therefore read this document alongside the ‘position’ statement. In fact, he has brought it to the point where one can ask what its teachings have to offer that cannot be found outside the scope of its experience and discourse. For example, the hope in immortality he evokes is certainly not peculiar to Catholicism or Christianity. Nor is it an exclusively religious doctrine: we find it in pagan philosophy from the Greeks onward, even in thinkers who did not believe in a personal god.... On a broader scale, it is clear that religious experience is available outside Catholicism and Christianity; and for many people natural human experience, with no religious or transcendent dimension, is satisfying enough. What, then, does Catholicism claim to provide that cannot be found beyond its boundaries? I am not asking about the subjective aspects of experience, be it natural or religious (its felt quality, psychological genesis, personal meaning, and so on). I am asking an objective theological question: what does Catholicism claim that makes it unique, essentially different from non-Catholic religions and non-religious humanisms? 3 Sheehan's answer to this last question is clear. That which makes Christianity unique and essentially distinctive and which traditional believers sought to clarify and defend moves Christianity to the periphery of the culture. By identifying themselves primarily with the tradition in terms of classical Christianity, no one hears what Christians have to say but themselves. The only alternative to this self-imposed isolation, holds Sheehan, is to be intelligible to contemporary educated, secularminded men and women: in which case Christian theism may well have interesting things to say, but these will not be significantly distinctive in any Christian sense. Thomas Sheehan, one of the most lucid exegetes of Heidegger in this country, has published the most original collection of essays on the philosopher since Michael Murray's Heidegger and Modern Philosophy. According to Sheehan, the collection aims to address two frequently misunderstood topics: Heidegger's "complex but simple thought and his simple but complex life." His thought is essentially concerned with a single question: the meaning of Being as disclosure. As for his life, it is mainly a matter of (...) furnishing a context to what Sheehan calls "that misguided sally from philosophy" from May, 1933 to February, 1934, during which Heidegger supported the Nazi regime. Yet Sheehan's assessment of the anthology is a bit too modest, for it is actually much more critical and eclectic than that. In addition to the direct treatments of the two topics, the collection contains essays on Heidegger's theories of art and technology, reflections on the political implications of his ontology, recollections by his contemporaries, and comparisons between him and other thinkers. Moreover, it contains the largest bibliography of Heideggerian material in English that has ever appeared. (shrink)

The object of the study is the works of the American doctor, journalist, marathon runner, popularizer of running and thinker George Sheehan (1918-1993), first introduced into scientific circulation by Russian researchers of the philosophy of sports: "Running and being: a complete experience" (1978) and "The main thing with Sheehan: 30 years of running wisdom of the legendary Dr. George Sheehan" (2013). The subject of the study is the cultural content of amateur stayer running, its personality-creating potential, explicated (...) from these works. The achievement of the cognitive goal is connected with the comprehension of the life path of Dr. Sheehan, his philosophical authorities, anthropological views, the phenomenology of running experience, as well as the social effect of the ideas he propagated. Recognized as the founder of the emerging philosophy of running, J. Sheehan considers amateur stayer running as an activity during which a qualitative transformation of the athlete's personality occurs, associated with the possibility of achieving religious and mystical contact with the primordial and deep dimensions of his being, providing creative impulses and insights. Using the example of his own life, the American researcher describes the bodily determined basic contradictions of the aspirations of an amateur stayer and the social environment, and also sees in running activity and the effects generated by it the foundations of their conjugation. Stayer running is understood by Dr. Sheehan as an environment of moral and volitional formation of an individual, aimed at comprehending his originality and affirming the personal meaning of existence, gaining ideological competence. The researcher fruitfully reveals the humanistic dimension of running on the basis of such concepts and existentials as "body wisdom", "game", "heroism", "running experience", "connection with the Absolute", "unique potential". Dr. Sheehan believes that the usual health-related arguments in favor of running are "pathetic ideas" compared to gaining the ability to live at your true level, to hear the "call of being" addressed to the individual, to achieve your "original splendor", to become the best version of yourself.
